WAIVER AND RELEASE OF LIABILITY FORM

I certify and confirm to Waitotara Valley Estate Ltd t/a Rumbling Adventures New Zealand (RANZ):

1. I have read, understood, and agree to comply with the rules, laws, safety precautions and terms and conditions (attached) displayed and/or explained to me verbally relating to the tour activities provided by RANZ (“the activities”). I understand that it is a condition of taking part in the activities that I must give the confirmations and certification set out in this form.

2. I have had the opportunity to ask RANZ all the questions that I have relating to the activities, and all information I require has been provided by RANZ.

3. I acknowledge that the activities involve riding motorcycles and are inherently dangerous. Careless actions or accidents within the activities carry the risk of serious injury or death, as well as damage to property. These risks can arise from my own actions and the actions of other people.

4. I do not have any physical condition or health problems which would make it unsafe or against medical advice for me to participate in the activities.

5. I assume and accept all of the risks involved in participating in the activities including (by way of example and not limitation) any risk, injury, or damage that may arise from the activities and from dangerous or defective equipment.

6. I will participate in the activities, in a manner that does not endanger either me or others.

7. I consent to receiving medical treatment in the event of illness or injuries suffered during or immediately after the activities.

8. I understand and agree that situations may arise during the activities, which may be beyond the immediate control of RANZ.

9. I agree to follow all reasonable safety instructions provided to me by RANZ (including all staff) before, during and after the activities.

10. I confirm and undertake on behalf of myself, my executors, administrators and successors as follows:

    • I waive, release and discharge RANZ from all liability of any kind, for my death, disability, personal
      injury, property damage, or any loss of any kind which I may suffer if I take part in the activities.

    • I indemnify RANZ from any and all liabilities or claims made as a result of me taking part in the activities, from whatever cause.

    • The certifications and confirmations contained in this form are given for the benefit of and extend to RANZ, its officers, its employees, its agents and representatives and the term RANZ in this form shall include all such persons.

11.     RIDER(S) RESPONSIBILITY

• Riding within the rules of the New Zealand Road Code.

• Riding within your own ability and doing so without endangering any person or property.

• Listening to the Guide for your ride.

• Ride within the speed limit.

• Should any malfunction of the motorcycle occur, any sign of overheating, you must stop the motorcycle immediately or you will be held liable and loss of bond may occur.

• The Rider is prohibited from exceeding laws in relation to the consumption of alcoholic beverages while operating any vehicle/ motorcycle during a ride, or the taking of ANY drugs that may impair judgment while riding.
